When asked to comment, Wagar said, “A deposition could make or break a medical malpractice suit, making it vital for the claimant to adequately and accurately prepare answers to tough questions beforehand.”

There are a couple of things, according to Wagar, a plaintiff can do to help ensure a deposition testimony doesn’t get impeached by the opposing attorney before trial, which would be detrimental to the case.

One good way to prepare is to become acquainted with previous deposition proceedings.

When asked to explain, Wagar commented, “Ask your attorney for a sample deposition if you haven’t already been provided with one. A sample will give you a good idea of what to expect during a deposition, such as the types of questions to be asked to both you and your physician.”

For example, by reading a sample, the plaintiff will be able to understand how the malpractice suit will be evaluated going forward.

Mock depositions and cross-examinations are also an essential part of medical malpractice lawsuit preparations for several reasons.

Expanding on this Wagar was quoted as saying, “Oftentimes, the opposing counsel will ask you the same questions repeatedly to test your consistency as a claimant. A mock deposition done with your lawyer can help you to recognize the same question asked different ways. The plaintiff's attorney will also be able to provide direction and advice on how to answer specific questions, particularly during cross-examination."

“Maintaining composure during your deposition will be vital to your case as the opposing counsel will probably harass or talk down to you. Working with your lawyer during a mock deposition can help you come up with measured answers to questions that help build a strong case against your physician," he added.

After doing a mock deposition with an attorney Wagar suggested it is a good idea for all plaintiffs to practice and polish their answers with family members or friends.

Another key takeaway from the interview with Wagar was the advice that plaintiffs should never come out with snap statements when answering deposition questions.

“If you don’t remember a certain fact that you think would help your case, don’t ever make things up as it could back fire and be made to look like a lie. More likely than not, the opposing attorney will spot a potential lie, and your testimony could be thrown out completely,” Wagar said.
